We act as:

Data Controller for personal data of our customers (e.g. account, billing, support).

Data Processor for personal data that our customers upload into the Platform for CRM, marketing, or other purposes.

We are committed to complying with the General Data Protection Regulation (GDPR), Hungarian law (Act CXII of 2011 on Information Self-Determination and Freedom of Information – “Infotv.”), and other applicable privacy laws.

3. Categories of Data We Process

As Controller (our own customers):

Identification data: name, company name, position.

Contact details: email address, phone number, billing address.

Account details: username, login credentials.

Payment and invoicing data: subscription details, VAT number, invoices.

Communication data: emails, support requests.

As Processor (on behalf of our customers):

CRM records: leads, clients, subscribers.

Contact details and marketing data.

Content uploaded by the customer into the Platform.

Customers remain responsible for ensuring they have a lawful basis to process their end-users’ data.

4. Purposes and Legal Bases

We process personal data for the following purposes:

Contractual necessity (Art. 6(1)(b) GDPR): to create and manage customer accounts, provide the Service, process payments.

Legal obligations (Art. 6(1)(c) GDPR): to comply with accounting, tax, and record-keeping laws.

Legitimate interests (Art. 6(1)(f) GDPR): to improve our services, ensure IT security, prevent fraud, and market to existing business contacts.

Consent (Art. 6(1)(a) GDPR): for optional marketing communications where required.

5. Data Sharing and Sub-Processors

We do not sell or rent personal data.

We may share personal data with trusted sub-processors for hosting, communications, and integrations, including (but not limited to):

Cloud hosting: Amazon Web Services (AWS), Google Cloud Platform (GCP).

Email/SMS providers: Mailgun, SendGrid, Twilio.

Payment processing: Stripe.

Support and analytics tools: [Insert as applicable].

Where data is transferred outside the EU/EEA, appropriate safeguards are applied, such as the European Commission’s Standard Contractual Clauses (SCCs).

6. Data Retention

Account and billing data: kept for up to 8 years in line with Hungarian accounting laws.

CRM/marketing data processed on behalf of customers: retained only for as long as the customer account is active or as instructed by the customer.

Support communications: retained for up to 3 years.

7. Security Measures

We implement appropriate technical and organizational measures (TOMs) to protect personal data, including:

Encryption in transit and at rest.

Secure multi-tenant hosting (AWS/GCP).

Access control and role-based permissions.

Backups and disaster recovery.

Breach detection and response procedures.

8. Data Subject Rights

As a data subject, you have the right to:

Access your personal data.

Rectify inaccurate data.

Erase data (“right to be forgotten”).

Restrict processing.

Object to processing (including direct marketing).

Lodge a complaint with the Hungarian Data Protection Authority (NAIH).

10. Updates

We may update this Privacy Policy from time to time. Updates will be published on our website with a new “Last Updated” date.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Hungary and applicable EU law.

All disputes shall fall under the exclusive jurisdiction of Hungarian courts.

Kalingo may amend these Terms from time to time. Customers will be notified of material changes. Continued use of the Service after changes take effect constitutes acceptance.
